Lack of Skill |
Can the License be Reinstated? When your driver's license is in jeopardy you have the right to a hearing or a re-examination conducted by a hearing officer in the Driver Safety Division of the Department of Motor Vehicles. Included in this right is the right to examine all of the evidence against you. After objectively viewing the case in its entirety, ask yourself if driving is in your best interest and does not pose an unreasonable risk to others. If you believe you are capable of safe driving, pursue a full hearing at DMV. Should I Hire a Lawyer? Many people with skill or knowledge actions are able to successfully retain or reinstate their licenses by representing themselves. An attorney is most helpful in cases with complicated legal issues or complex fact patterns. Additionally, those who are uncomfortable making a presentation often prefer to have a professional orchestrate the presentation of facts and legal arguments. In many cases however, a typical subject can perform adequately with some counselling. In sum, it is a question of degree and cost versus benefit. What is the Liklihood for Reinstatement? In our experience the majority of those who face a "lack of skill" revocation and attempt to maintain their privilege to drive are successful. It may, however, require some perseverance as several DMV dates may have to be set including multiple test dates. Further, it is important to realize that one failure or bad experience with DMV is not the end of the road. In fact, many people who ultimately obtain their licenses fail at one point or another in the process.
